Any actions that involve dishonest conduct, lying, cheating, stealing, or any unethical behavior that negatively affects the Member or Candidate&#8217;s professional activities would be considered a violation of the Standard.<\/p>\n<p>Actions that damage the trustworthiness, competence, and inability to carry out his or her professional activities would conflict with Standard I(D).<\/p>\n<p>Violations of Standard I(D) \u2013 Misconduct include, but are not limited to:<\/p>\n<ul>\n<li>A member or candidate consuming alcohol during working hours.<\/li>\n<li>Personal bankruptcy arising out of fraud or deceitful action.<\/li>\n<li>Failure to perform adequate due diligence or delegating research responsibilities.<\/li>\n<\/ul>\n<h2>\u00a0Compliance Recommendations<\/h2>\n<ul>\n<li><span style=\"font-weight: normal !msorm;\"><strong>Code of Ethics:<\/strong><\/span> Firms should develop a Code of Ethics that employees are required to follow. Firms should ensure that employees are aware that any misconduct will not be tolerated.<\/li>\n<li><span style=\"font-weight: normal !msorm;\"><strong>List of violations:<\/strong><\/span> Firms should disseminate a list of potential violations and relevant disciplinary actions to all employees.<\/li>\n<li><span style=\"font-weight: normal !msorm;\"><strong>Employee references:<\/strong><\/span> Employers should screen potential employees to ensure that they are of good character.<\/li>\n<\/ul>\n<blockquote>\n<h3>\u00a0<span style=\"font-weight: normal !msorm;\">Application 1: Professionalism and Competence<\/span><\/h3>\n<p>Ewart Lucas is a portfolio manager at Brisk Insurance. He has frequent meetings with his team at a bistro next to the company\u2019s headquarters. After a stressful management meeting, he takes his team out for lunch and orders a bottle of wine. The other members of his team decline to consume the wine. He states that he is \u201cmore relaxed and able to produce better results\u201d after he has consumed a few glasses of wine.<\/p>\n<p>Has Lucas violated Standard I(D) \u2013 Misconduct?<\/p>\n<p>\u00a0 \u00a0 \u00a0A. Yes, because consuming alcohol during working hours could impair his judgment and his ability to carry out his responsibilities.<\/p>\n<p>\u00a0 \u00a0 \u00a0B. No, because Lucas is out of the office \u2013 he is allowed to do whatever he likes during his lunch break.<\/p>\n<p>\u00a0 \u00a0 \u00a0C. No, because his claim of superior performance after a few drinks is beneficial for his clients and the firm.<\/p>\n<h4>Solution<\/h4>\n<p><strong><em>The correct answer is A.<\/em>\u00a0<\/strong><\/p>\n<p>Lucas has violated Standard I(D) \u2013 Misconduct.
